3. Use of This Website
Permitted Use
You may use this website for lawful purposes only — specifically to learn about our services, request estimates, contact us, or access informational content. You agree not to use the website in any way that is unlawful, harmful, fraudulent, or that could damage, disable, or impair the website or interfere with any other party’s use of it.
No Unlawful or Prohibited Use
You may not attempt to gain unauthorized access to any part of the website, its servers, or any server or database connected to the website. You may not use automated tools to scrape, copy, or index content from this website without our prior written consent.
Accuracy of Information You Provide
When you submit a contact form, estimate request, or any other inquiry, you agree to provide accurate, complete, and current information. Providing false information — including misrepresenting a property address, ownership status, or insurance claim status — may result in termination of any project engagement and potential liability for costs incurred.
4. Estimates, Proposals, and Contracts
Free Estimates
We provide free written estimates for all residential and commercial projects within our service area. An estimate is not a contract and does not obligate either party to proceed. Estimates are valid for 30 days from the date issued unless otherwise noted. Material pricing fluctuations may require estimate revision after 30 days.
Project Contracts
No work will begin on any project without a written contract signed by both parties. The written project contract — not this website, these Terms, or any verbal communication — governs the specific scope, pricing, timeline, payment schedule, and warranty terms for each project. In the event of any conflict between these Terms and a signed project contract, the signed project contract controls.
Scope Changes
Any change to the agreed project scope must be documented in a written change order signed by both parties before additional work is performed. Verbal authorizations for scope changes are not binding on AARC.
Payment Terms
Payment terms are specified in each individual project contract. Unless otherwise agreed in writing, we require a deposit prior to material ordering and a final payment upon project completion. We reserve the right to suspend or terminate work on any project where payment obligations are not being met per the contract schedule.
5. Insurance Claims and Restoration Work
Where AARC assists with insurance restoration claims on your behalf, we do so as a contractor — not as a licensed public adjuster, attorney, or insurance professional. Our assistance includes documenting damage, meeting adjusters on-site, preparing Xactimate-format scope documentation, and filing supplements. We do not provide legal advice, and our assistance does not create an attorney-client or fiduciary relationship.
You remain responsible for all communications with your insurance carrier, for the accuracy of any claim you submit, and for paying your deductible as required by your policy. We will never request, accept, or facilitate waiver of your deductible — this practice constitutes insurance fraud under North Carolina law, and we will not participate in it under any circumstances.
Supplement filing and claim advocacy are provided as part of our project service. We make no guarantee of any specific claim outcome, approved scope amount, or carrier payment. Insurance coverage decisions are made solely by your carrier.
6. Warranties
Specific warranty terms — including manufacturer product warranties and AARC workmanship warranty coverage, duration, and exclusions — are set forth in each individual project contract and closeout documentation. Nothing on this website constitutes a warranty of any kind.
Manufacturer warranties are issued by the manufacturer, not by AARC. AARC makes no representations regarding the terms, enforceability, or future availability of any third-party manufacturer warranty. We will assist with warranty registration on your behalf, but ultimate responsibility for registration rests with the property owner.
Warranty coverage may be voided by: unauthorized modifications to the installed work; failure to maintain the property in a manner consistent with manufacturer recommendations; natural disasters or acts of God beyond the scope of the original installation; or failure to pay any amounts owed under the project contract.
7. Limitation of Liability
To the maximum extent permitted by applicable North Carolina law, AARC’s total liability to you for any claim arising from or related to these Terms, the website, or any project engagement shall not exceed the amount actually paid by you to AARC under the specific project contract giving rise to the claim. This limitation applies regardless of the theory of liability (contract, tort, negligence, or otherwise).
AARC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of this website or from any project engagement, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages — in such jurisdictions, our liability is limited to the extent permitted by law.
AARC is not responsible for delays caused by factors outside our reasonable control, including but not limited to weather events, material supply chain disruptions, permit processing delays by municipal authorities, or acts of God.
8. Disclaimer of Warranties — Website
This website and its content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.
Information on this website — including pricing ranges, timelines, material descriptions, and warranty summaries — is provided for general informational purposes only. It is not a substitute for a written project estimate or contract. Actual pricing, timelines, and warranty terms for any specific project are governed solely by the applicable written project contract.
9. Intellectual Property
All content on this website — including text, photographs, graphics, logos, and the overall design — is the property of Above All Roofing & Construction, LLC or its content providers and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any website content without our prior written permission.

10. Third-Party Links and Services
The website may contain links to third-party websites, including manufacturer sites, review platforms, and social media profiles. These links are provided for your convenience only. We have no control over the content or practices of third-party websites and accept no responsibility for them. A link does not imply endorsement of the linked website or its content.
11. Privacy
Your use of this website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the website, you consent to the data practices described in our Privacy Policy.
12. Governing Law and Dispute Resolution
These Terms and any dispute arising from your use of this website or from any project engagement shall be governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts of competent jurisdiction located in North Carolina, and you consent to personal jurisdiction in those courts.
Before initiating any legal action, you agree to first contact us in writing at accounts@aarcroofs.com and allow 30 days for a good-faith attempt to resolve the dispute informally.
13. Indemnification
You agree to indemnify, defend, and hold harmless AARC, its owners, officers, employees, agents, and contractors from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: your use of or access to this website; your violation of these Terms; your violation of any third-party rights; or any project engagement where your misrepresentation of material facts contributed to a loss or claim.
14. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
15. Entire Agreement
With respect to your use of this website, these Terms (together with our Privacy Policy) constitute the entire agreement between you and AARC. With respect to any specific project engagement, the signed project contract supersedes and constitutes the entire agreement between the parties for that project, and these Terms apply only to the extent not inconsistent with the project contract.
